CALIFORNIA APPLICANT PRIVACY NOTICE

This California Applicant Privacy Notice (this “Notice”) aims to give California residents who are job applicants, potential candidates for employment and who participate in recruiting programs and events (“Applicants” or “you” or “your”) of Team Holdings, Inc. and its subsidiaries, affiliates, and family of companies which does business under the brand name of TeamHealth (also referred to as “we”, “us” or “our” throughout) information on how their personal information is processed by TeamHealth. We define “personal information” broadly to mean information from which you are identifiable or can be identified, or other information about you that can be linked to you. In addition, processing means any activity relating to personal information, including, by way of example, collection, storage, use, consultation, disclosure, sharing and transmission. This personal information may be submitted to TeamHealth through the online application process and any follow-up communications and/or alternative channels (e.g., professional recruitment firms and agencies). If you do use our website, TeamHealth.com, as part of your application process, please also refer to our Privacy Policy.

This Notice is issued by TeamHealth as data controller (i.e., a person or organization who alone or jointly determines the purposes for which, and the manner in which, any personal information is, or is likely to be, processed).

Note that this Employee Privacy Notice does not apply to “protected health information” governed by the Health Insurance Portability and Accountability Act (“HIPAA”). To the extent we collect protected health information, we only process that information to the extent permitted by, and consistent with, applicable HIPAA requirements.

1. What types of personal information do we collect and why?

TeamHealth has collected the following categories of personal information from Applicants within the last 12 months. Note that the categories listed below are defined by California state law. Inclusion of a category in the list below indicates only that we may collect some information within that category. It does not necessarily mean that we collect all information listed in a particular category for all of our Applicants. We collect this personal information (or a subset of this personal information) directly from you or from our service providers; we may also collect it from publicly available job or professional networking sites where you have posted such personal information. We may also collect this information from government agencies or other third parties (e.g., former employers or recruiters). We have shared the data below with third parties as described in Section 2.

We do not sell your personal information or share it with third parties in order to target advertising based on personal information obtained from your activity across businesses, distinctly‐branded websites, applications, or services, other than our websites and services with which you intentionally interact.

Category Purpose of Collection

Personal identifiers. Identifiers such as a real name, alias, postal address, Internet Protocol address, or email address.

A subset of this data is collected to:

  • Manage your application, including evaluating your candidacy, qualifications and experience, interviews with you, consultation with recruitment firms and references you have provided to us as part of the application process.
  • Create records in our Human Resources and recruitment systems to manage our recruitment process.
  • Ensuring our compliance with laws and regulations, including verifying your right to work.
  • Process and manage applications for roles at TeamHealth, evaluate you for open positions that match your interests and experience across TeamHealth and manage your candidate profile.
  • Organize an interview, and to make you aware of employee benefits you may elect to receive or to determine any accommodations you may require (if you are required to travel to us to interview, we may use a subset of this information to arrange your travel).
  • This information is also used for marketing purposes, including offering you opportunities or services that may interest you.

Information about you.Information that identifies, relates to, describes, or is capable of being associated with, a particular individual, including, but not limited to, your name, signature, address, telephone number, education, employment, or employment history.

A subset of this data is collected to:

  • Manage your application, including evaluating your candidacy, qualifications and experience, interviews with you, consultation with recruitment firms and references you have provided to us as part of the application process.
  • Create records in our Human Resources and recruitment systems to manage our recruitment process.
  • Ensuring our compliance with laws and regulations, including verifying your right to work.

Characteristics of classes protected under federal or California law. Familial status, disability, sex, race, gender identity and gender expression, marital status, veteran status, or age.

A subset of this data is collected to:

  • Comply with our legal obligations.
  • Further our commitment to diversity and inclusion programs and practices.
  • Organize an interview, and to make you aware of employee benefits you may elect to receive or to determine any accommodations you may require (if you are required to travel to us to interview, we may use a subset of this information to arrange your travel).
  • This information is also used for marketing purposes, including offering you opportunities or services that may interest you.

Sensory data.Audio, electronic, of visual, information. For example, this may include recordings of calls to our call center or security camera footage at our facilities.

A subset of this data is collected to:

  • Manage your application, including evaluating your candidacy, qualifications and experience, interviews with you, consultation with recruitment firms and references you have provided to us as part of the application process.
  • It is also processed in order to help detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, and for compliance management.

Professional or employment-related information.Work history, academic and professional qualifications, educational records, references, interview notes, job title, position, hire dates, and compensation.

  • Manage your application, including evaluating your candidacy, qualifications and experience, interviews with you, consultation with recruitment firms and references you have provided to us as part of the application process.
  • Create records in our Human Resources and recruitment systems to manage our recruitment process.
  • This information is also used for marketing purposes, including offering you opportunities or services that may interest you.

In addition to the categories of personal information above, we collect the following categories of sensitive personal information, none of which we share with third parties or to personalize marketing:

Social security, driver's license, state identification card, or passport number.

  • Ensuring our compliance with laws and regulations, including verifying your right to work.
  • Protecting against fraud.
  • Keeping your information accurate and up-to-date.

We do not process sensitive personal information beyond what is reasonably necessary to meet the purposes described above. We may rely on service providers to assist us with these efforts.

2. Who do we disclose your personal information to and why?

TeamHealthmay disclosecertain personal information, including sensitive personal information,for the purposes listed in this Notice to the following recipients:

  • To our affiliates, which include TeamHealth Holdings, Inc. and its subsidiaries, so they can help us manage your application.

  • To our third party service providers to facilitate the services they provide to us (e.g., IT service providers, background screening providers and employment benefit providers) so we can process your application.

  • To fraud prevention agencies, law enforcement agencies, public and government authorities to meet our legal obligations.

  • As required or permitted by law, including to comply with a subpoena or similar legal process or government request, to entities or persons whenTeamHealth reasonably believes that disclosure is legally required.

  • In connection with a sale, merger or acquisition.

We may receive your personal information, or sensitive personal information, from the following sources:

  • Directly from yourself.

  • External recruitment agencies.

  • Employment screening and background check providers.

  • Publicly available sources, such as LinkedIn.

  • Employment references you provide.

  • Regulatory or governmental bodies/organizations.

3. How long do we keep your personal information?

TeamHealth will take steps to protect Applicant personal information against loss or theft, as well as from unauthorized access, disclosure, copying, use or modification, regardless of the format in which it is held.

We will keep your personal information for as long as is necessary for the purposes we originally collected it for, or for as long as we are allowed to keep it under data protection laws. For example,if you accept a job offer from us, we will keep personal information collected about you during the application process and your CV in your personnel file. If we do not employ you, we may nevertheless continue to retain and use your personal information for a period of time, to consider you for future employment opportunities at TeamHealth.

4. What are your rights regarding your personal information?

As a California resident, you may be entitled to all or some of the rights described below regarding your personal information, subject to certain conditions and limitations. Only those rights relevant to you will apply, and our inclusion of information about privacy laws does not imply that all privacy laws are applicable.

  • Right to Know – You may be entitled to request that we disclose to you personal information we have collected about you, the categories of sources from which we collected the information, the purposes of collecting the information, the categories of third parties to whom we have disclosed the information, the categories of personal information that we have disclosed to third parties for a business purpose, the categories of information sold, and the categories of third parties information is sold to. In some instances, you may have the right to receive the information about you in a portable and readily usable format. Before providing any of this information, we must be able to verify your identity. 
  • Right to Opt-Out – You have the right to opt-out of information sharing that constitutes “sharing” personal information under California law. 
  • Right to Deletion – Subject to certain conditions, you may be entitled to request that we delete personal information about you. Before deleting personal information, we must be able to verify your identity. We will not delete personal information about you when the information is required to fulfill a legal obligation, is necessary to exercise or defend legal claims, or where we are required or permitted to retain the information by law.
  • Right to Correction– You may be entitled to request that we correct inaccurate personal information. Before collecting personal information, we must be able to verify your identity. We will not correct personal information about you when the information is required to fulfill a legal obligation, is necessary to exercise or defend legal claims, or where we are required or permitted to retain the information as-is by law.

Data solely retained for data backup purposes is principally excluded from these rights until it is restored to an active system or next accessed or used for a sale, disclosure, or commercial purpose.

If you choose to exercise any of these rights, to the extent that they apply, privacy law prohibits us from discriminating against you on the basis of choosing to exercise your privacy rights.

Please note that under applicable privacy law, we are only obligated to respond to personal information requests from the same consumer up to two times in a 12-month period. In addition, under applicable privacy law, and for the protection of your personal information, we may be limited in what personal information we can disclose.

California law also permits you to request in writing a list of the types of personal information that we have disclosed to a third party for their direct marketing purposes during the preceding year and to whom that information was disclosed.

5. How can I exercise my rights and submit a personal information request?

Before providing information you request in accordance with these rights, we must be able to verify your identity. In order to verify your identity, you will need to submit information about yourself, including your name, contact information, and, to the extent applicable, providing your account login credentials. We will match this information against information we have previously collected about you or provided to you to verify your identity and your request. If we are unable to verify your identity as part of your request, we will not be able to satisfy your request. We are not obligated to collect additional information in order to enable you to verify your identity. For deletion requests, you will be required to submit a verifiable request for deletion and then confirm separately that you want personal information about you deleted.

If you would like to appoint an authorized agent to make a request on your behalf, you must provide the agent with written, signed permission to submit privacy right requests on your behalf. Alternatively, your authorized agent may provide evidence of having power of attorney or acting as a conservator for you. Note that we may require you to verify your identity with us directly before we provide any requested information to your authorized agent unless your authorized agent has power of attorney or acts as a conservator, in which case we will not contact you directly.

Information collected for purposes of verifying your request will only be used for verification.
